This “Privacy Policy” applies when you access or use our website (“Our Site”) or our service (“Our Service”) and it may be found online at https://makingsoftwaremakers.com/privacy.  This Privacy Policy outlines how Ward Media Ventures, LLC, dba Making Software Makers (“we,” “us,” or “our”), may collect and/or use information from you in conjunction with your use of Our Site and Our Service. 

We are committed to protecting the privacy of users of Our Service and this Privacy Policy states our privacy practices which apply to users of Our Service and any related user account. We and/or our licensors own, operate, and maintain Our Service.

We intend to comply with the Children’s Online Privacy Protection Act (“COPPA”), a law designed to protect the online privacy of children under the age of 13. We will not require a child to provide more data that is reasonably necessary to use the Service. Prior to any creation of user account or access to Our Site or Our Service, you, or your parent or legal guardian if you are under 13, must provide informed and valid consent before we collect any personal information. We have the right to revise this Privacy Policy at any time, and will endeavor to provide notice if any material changes are made to this Privacy Policy and obtain consent where necessary. Any changes will be effective when posted as reflected by the “Last Updated” date above. We encourage you to check this privacy policy frequently for changes. Information We Collect

For purposes of this Privacy Policy, “Personal Information” includes all individually identifiable information that is specific to an individual person, such as, full names (first and last), home or other physical addresses, online contact information such as email addresses or other substantially similar identifiers that permits direct contact with a person online, screen names or user names where it functions in the same manner as online contact information, telephone numbers, Social Security numbers, persistent identifiers that can be used to recognize a user over time such as cookies, IP addresses or other unique device identifiers, photographs, videos, or audio files where the file contains images or voices, geolocation information, and any information combined with an identifier. With the exception of our Third Party Providers (including our payment processor and any data host provider), we will not provide any Personal Information you may provide to us or that we may collect through Our Site and Our Service to any third parties without your express consent.

We require users of Our Site and Our Service to have a related user account. Your user account may allow for an email address as a user name. We may also collect certain Personal Information you voluntarily submit as part of your registration/login into Our Sites or Our Service and your choice to opt-in to any marketing campaigns or other links through Our Site or Our Service whether through emails or other communications sent by us. The types of Personal Information we may collect include your name (including first and last name), age, email address, and user account information such as username and password. Furthermore, after a user uses our Third Party Provider’s (i.e. Stripe as our payment processor) payment method to pay for the Service, we may collect and store information such as the Stripe customer numbers, Stripe subscription numbers, transaction charge numbers, IP addresses, and the last four digits and expiration date of a user’s credit card so that we may verify payment for our Service. Please see Stripe’s privacy policy for information about what type of personal data Stripe collects. We may also collect information as a result of your interaction with any of Our Sites or Our Service, our marketing materials and/or any newsletter or other communication we send. This means we may collect information from you through multiple locations, not just the initial one of Our Sites, or Our Service, through which you register for a user account.

We strictly limit the personal information that is publicly viewable about a user. The Site allows for testimonials of certain users. When a user posts a testimonial, only the user’s first name and age will be posted along with the testimonial. We may also collect information regarding a user’s use of Our Service with software application tools and data files, such as cookies, web log files, clear GIFs, pixels and/or similar devices, to identify our users and their devices, including by IP addresses, device state information, unique device identifiers, device hardware and OS information, and information relating to how Our Service are functioning (“Operational Information”). You have the ability to control access to such Operational Information through the control settings on your device. You can remove or reject persistent cookies by following the directions provided in your Internet browser’s “Help” file. If you remove a persistent cookie, you may be requested to re-register or log in again upon returning to Our Sites or Our Service or when opting-in to any of our marketing campaigns via email or newsletters. If you reject persistent cookies, the functionality of Our Sites, Our Service, or other communications (like our newsletters), or any part thereof, may be impaired or unavailable. If we identify that you are accessing Our Sites or Our Service through multiple devices, we will associate each such device with your profile.

Please note that your election to remove our access to Personal Information, Location Information or Operational Information may impact the functionality of Our Service.  If you have any questions about our use of Personal Information, Location Information or Operational Information, please feel free to contact us. To clarify, we will not collect any video or images of a user.

Use and Disclosure of Your Information

We will use the Personal Information you provide us only for the specific purpose of providing Our Service and only to the extent reasonably necessary to provide Our Service. We may use the information we collect from you in the following ways:

  • Identify and verify your right to access your user account.
  • Personalize and enhance your experience while interacting with our Site and Our Service.
  • Provide our Service’s functionality and Our Service to you through Our Site.
  • Deliver the type of content and services that we believe may be of interest to you, including emails, newsletters, alerts, and advertising targeted to your use of Our Site and/or Our Service and/or interests based on your professional activities and/or information we possess.
  • Monitor usage and interaction statistics on Our Site, Our Service, and/or through responses to our communications.

We use the Operational Information to perform data analytics, and analyze and evaluate the features and functionality of Our Service. We may also use Operational Information to process automatic crash reporting which collects reports of crashes, other technical issues, and information relating to how Our Service is functioning.

As noted in our Terms, you acknowledge that we contract with third party development, application and data hosting, wireless network services, payment processing, and other technology services providers such as mobile app store providers to provide Our App functionality (“Third-Party Providers”). We are responsible for ensuring that the Third-Party Providers abide by the Terms. We are solely responsible for monitoring and supervising all necessary work of the Third-Party Providers. With the exception of our Third Party Provider (i.e., Stripe as our payment processor), we will not share Personal Information or Location Information with a third party without your prior authorization, unless doing so is necessary (1) to enforce this Privacy Policy, to comply with law, regulation or other legal processes or to protect the rights, property or safety of us or others, (2) to comply with a valid order or process from a public authority, (3) to protect against misuse or unauthorized use of Our Service, (4) to detect or prevent criminal activity or fraud, (5) in the event that we or substantially all of our assets are acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation or liquidation, in which case such information may be one of the transferred assets or (6) to Third Party Providers who help us operate or manage the Site and the Service.

Protection of Personal Information

Although we cannot guarantee the security of Personal Information that is transmitted over the Internet or stored on Our Sites or Our Service, we have security procedures in place. Data security is implemented through physical, administrative, and technical safeguards we put in place and operational procedures we follow to protect your Personal Information. We restrict access to your Personal Information in our database to our authorized employees, agents, certain of our Third Party Providers as appropriate or necessary to provide Our Service. 

Please note that we do not have any control over or responsibility for information you share about yourself on or through any websites outside of Our Sites or Our Service; including any third party websites accessed or linked through Our Sites or Our Service. All such sharing of information and content is done at your own risk. Any concerns over the sharing of information on or with a particular website not owned by us should be handled by dealing directly with that website.

Parent Rights under COPPA

Under COPPA, if you are a parent of a child user (e.g. any user under the age of 13), you have certain rights, including asking us to:

  • Allow you to review your child’s Personal Information.
  • Allow you to update or change your child’s Personal Information. 
  • Delete Personal Information your child has given us.
  • Stop collecting Personal Information from your child.

Other Rights

If you are over the age of 12, you may have certain rights, depending on the applicable law and regulations, including the following:

  • Your right to Access – means you can ask us for a copy of any Personal Information we hold about you.
  • Your right to Correct – if you believe that any of the Personal Information we hold about you is incorrect or out of date, you have the right to correct such Personal Information by providing us with the correct up-to-date Personal Information.
  • Right to Erasure – you can ask us to delete the incorrect or out-of-date Personal Information and we will be happy to do so unless we are prevented from doing so by law or regulation. In certain circumstances you may also have the right to ask us to erase your Personal Information. For example, if you no longer wish to use Our Service.
  • Right to Portability – you have the right to request a copy of your Personal Information in a commonly used and machine readable format to be provided to you or to such other third party as you specify.
  • You may opt out of receiving email communications by following the method stated in the Privacy Policy, or by utilizing the opt-out mechanism found in each email sent by us or a verified third party sending emails on our behalf to you. This will remove you from the email list or the website registration list and/or the sponsor of the communication.

Where We Store and Process Personal Data

Personal data collected by us is stored and processed in the United States. The storage location(s) are chosen in order to operate efficiently, to improve performance, and to create redundancies in order to protect the data in the event of a server outage or security incident. Personal Information is processed according to the provisions of this Privacy Policy and the requirements of applicable law wherever the data is located.

Non-Personal Information

In addition to you providing us with Personal Information, you may also provide us with or we may otherwise acquire non-Personal Information (i.e., information which does not personally identify you). We reserve the right to use and/or disclose such non-Personal Information as we choose, including to third parties, for any reason (e.g., marketing and advertising).  This includes information that has been de-identified and/or subjected to pseudonymization.

We may aggregate information that you provide or is otherwise collected from or about you with information provided by other individuals in such a manner that the information is not personally identifiable to you. Once such information is non-Personal Information, we reserve the right to use and/or disclose such non-Personal Information as we choose, including to third parties, for any reason (e.g., marketing and advertising).
